Q1. Can you exceed this Federal rate?
A: Yes, you can. If this statement sounds like a contradiction, you need to remember the IRS Code is full of contradictions. Read the rules. Find IRS Publication 463, or the link to it, select chapter 6, go to "reimbursements" and read up on the subject of "high-low rate". The rule book says the "high rate" (for New York City, San Jose, etc.) is $201 per day; for any other location in the Continental United States the lowest rate (or "low rate") is $124 per day. (21-A6)
